TERMS OF USE FOR ALL USERS - PLEASE READ THESE TERMS OF SERVICE CAREFULLY

By using our website ("https://www.itsy.dev" and its network of websites) or Android/iOS application (“Itsy”) or any other products or services offered by Itsy International Limited, you enter into an agreement with us.

Itsy is a new product, therefore we only run the beta versions of our web and mobile platforms.
Interpretation
  1. We refer to our website/mobile applications, mentioned above as (“Itsy”, “us” or “we”).
  2. “User” refers to any user of Itsy (also referred as “you” or “customer”), whether a host or a participant defined below.
  3. “Room” is a major service we provide, which is an educational, charitable or entertaining digital conference held at Itsy. Entry to each room can be either free of cost or priced. Each room might have a limit of participants (amount of users who enroll in the room). Each room has a set of its own rules that a user agrees to, upon enrollment.
  4. “Host” refers to any user who created the room or “co-host” (a user who is invited to the room) of the room. Itsy host should be at least 18 years old, or have a parent's permission to proceed creating rooms. Each host needs to have the following sections of agreements read in full before hosting a room: payments, fees, taxes and restrictions.
  5. “Participant” refers to every other user of Itsy, who are not hosts.
Introduction
Itsy is a streamline platform, dedicated to serve as a medium for chatting and audio/video streaming between hosts (celebrities, influencers or other well known people in their area of work, not excluding others) and participants. We believe that we make unreachable reachable, however to make this happen we do ask our most respected users to read our terms of service in full before agreeing and proceeding.

When using the Itsy Services, you will be subjected to Itsy's Community Guidelines and additional guidelines or rules that are posted on the Itsy Services, made available to you, or disclosed to you in connection with specific services and features. Itsy may also offer certain paid services, which are subject to the Itsy Terms of Sale as well as any additional terms or conditions that are disclosed to you in connection with such services. All such terms and guidelines (the “Guidelines”) are incorporated into these Terms of Service by reference.

The Terms of Service apply whether you are a user that registers an account with the Itsy Services or an unregistered user. You agree that by clicking “Sign Up” or otherwise registering, downloading, accessing, or using the Itsy Services, you are entering into a legally binding agreement between you and Itsy regarding your use of the Itsy Services. You acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms of Service, do not access or otherwise use any of the Itsy Services.

Use of Itsy by Minors and Blocked Persons
The Itsy Services are also not available to any users previously removed from the Itsy Services by Itsy or to any persons barred from receiving them under the laws of the United Kingdom or applicable laws in any other jurisdiction.

User account
  1. To create an account a person must be at least 13 years old. In case of which they must provide a valid email address, soon to be verified, and agree to keep one's information up to date if they change.
  2. Upon joining or creating a room, a participant or a host agrees on each room's rules, which are disclosed publicly.
  3. Customers are responsible for anything that occurs when anyone is signed into their accounts, meaning the security of their accounts. Please contact Itsy immediately if you believe that your account is compromised.
  4. We are not responsible for any lost, stolen, or compromised User accounts or any resulting unauthorized activities such as unauthorized payments.
Abusive conduct
Customers are responsible for all activity on their account. If a customer violates our policies we may terminate their account. Illegal, abusive or nsfw content is prohibited on our platform. These policies cover most issues, but if you find a new and creative way to hurt Itsy or our community we may take action to prevent it.
Payments, refunds and penalties
Payments fall into two sections: “checkout” and “payout”:

  1. Checkout (funds that users pay to acquire access to Itsy services):
    We trust Stripe (referenced as “they” or “them,” only within this section) to operate as our checkout medium, between users and Itsy.

    1. In case of opening a dispute on fraudulent transactions, our team will be supportive to resolve a case. We would first have to check the validity of the dispute and the period for that will vary from 1-4 weeks, as we are dependent on Stripe.
    2. In case the room gets canceled we will reimburse the amount to your profile spending wallet instantly, ready to be used. However, the user would have to contact us on refunds@itsy.dev if they prefer to receive the refunded amount to their bank accounts, which additionally takes up to 4 weeks, as once again we are dependent on Stripe.
    3. In case the room does not get canceled, the user can still request a refund, although the request may or may not be approved by our team, depending on the actual case. User has 24 hours after the room completes to file a report for that room. The reasons may vary: the host did not show up, or has ended the room early (before 70% of its completion), or has abused/insulted/discriminated against the user, violated Itsy agreement, etc. Our team will review every case and respond within 2 weeks.

    We try to provide timely access to your funds, but you may occasionally experience delays in accessing your funds.
  2. Payout (funds Itsy transfers to hosts):

    We rely on Wise bank for payouts. Every host should have their emails up to date, since the transfer will happen through the user email address. If the host has a Wise bank account and if the user used the same email for both Wise and Itsy, the funds will be transferred directly to their Wise account. If the host does not have a Wise bank account, Wise will contact the host through their verified email address to request their bank details, and the transfer will be directed to their specified bank account. Payouts will occur every two weeks. There may be some delays due to international transaction regulations, but we will do our best to provide the necessary information to avoid delays and ensure timely payment to the host.

    1. After a room is completed, the funds that the host has raised will be in a pending state for the next 24 hours before they are transferred to the payout balance. During this time, any funds that are reported and not yet resolved by our team will remain in a pending status until each issue has been resolved by our team.
    2. If a room is canceled, the host will be charged a fine of 5% of the total funds raised for that room and their profile rating will be reduced. The same fine will be applied if the host does not participate or starts the room more than 10 minutes after the scheduled time. In rare cases, applied fines may result in a negative account balance. In such instances, we reserve the right to recoup the negative balance from future payments. Repeated cancellations of rooms may result in the suspension of the host's account.

    We may also block or hold payments for violations of our policies or for compliance reasons, including collecting tax reporting information. When payments are blocked we try to communicate the reason to you promptly. If you have questions about a payments block, please reach us to payouts@itsy.dev.
Fees
As a host there are two fees associated with your services on Itsy. The first is the platform fee, which by default is 30%, if not agreed otherwise. The second is the payment processing fee, which is dependent on the currency selected by the host, although at a beta stage the only currency we operate is the United States Dollar ($).

  1. The payment processing fee in US Dollars is 2.9% plus $0.30 per successful pledge for pledges over $3, and 5% fee plus $0.10 per successful pledge for pledges of $3 or less.

Depending on the host's locations, some banks may charge a foreign transaction fee for payouts. Itsy does not control this charge, but it is typically around 3.0% .
Restrictions
In accordance with our policies, we do not allow "creations" (rooms) or "benefits" (takeaways from room sessions) that violate our restrictions. These rules include, but are not limited to, prohibition of:

  1. Profile creation for individuals under 13
  2. Individuals under the age of 18 are not allowed to create rooms, unless they are over the age of 13 and present obtained parental permission.
  3. Illegal or abusive creations or benefits
  4. Creations or benefits that use others' intellectual property without written permission or protected by fair use
  5. Creations or benefits involving sexual acts
  6. Benefits that involve raffles or prizes based on chance
